IPC SECTION 511 – PUNISHMENT FOR ATTEMPTING TO COMMIT OFFENCES PUNISHABLE WITH IMPRISONMENT FOR LIFE OR OTHER IMPRISONMENT

Whoever attempts to commit an offence punishable by this Code with imprisonment for life or imprisonment, or to cause such an offence to be committed, and in such attempt does any act towards the commission of the offence, shall, where no express provision is made by this Code for the punishment of such attempt, be punished with imprisonment of any description provided for the offence, for a term which may extend to one-half of the imprisonment for life or, as the case may be, one-half of the longest term of imprisonment provided for that offence, or with such fine as is provided for the offence, or with both.

EXPLANATION

            Section 511 of IPC deals only with those who attempt to commit the offence, in which the crime or offence is unsuccessful. Whoever did or performed the said crime, first they have the intention or plan already set up in their mind. Secondly, after the plan, they prepare for the said plan or intention simply, which they prepare for the plan. Thirdly after preparation they attempt to commit the plan, which they perform the offence or crime.

           Regarding the punishment this section does not exactly provide, the punishment is provided by the offence they perform by the relevant section. This section falls into the category in which the crime scene is unsuccessful. So, this section provides the punishment as “one-half of the imprisonment for life” which we jump back to section 57 of the same Code. Which provides for calculating the fraction punishment. In this section imprisonment for life is 20 years, if it is calculated in half it becomes 10 years. So “one-half of the imprisonment for life” of section 511 is 10 years. Not only this for other imprisonment such as given 2 years or 3 years by other section according to the offences committed, all this shall be divided into half years. So, this section is all about the offence where the crime scence is unsuccessful.

For Example: B attempts to assassinate C, but in the course of action to kill C. C missed the bullet fired by B. So, in such a situation B shall be punished under the said section 511 in the course of an attempt to assassinate C.
